1. Introduction

The purpose of this document is to regulate the general terms and conditions of contracting the Reservation services at Hotel Tàrbena, with address at Carrer Santíssima Trinitat, 1, Tàrbena, Alicante, Spain. Email: info@hoteltarbena.com

The contracting of these services means the acceptance of all the general terms and conditions exposed at the time of the client’s access to the website.

2. Area of ​​application

The terms and conditions contained in this document will apply to the relationship between the visitor (hereinafter referred to as “Client”) and the Hotel Tàrbena from the moment the reservation is requested until the date on which the period of accommodation at the hotel ends. .

In matters to which the Terms and Conditions do not refer, current Spanish law will apply.

3. Reservation Service:

The client can reserve in the following ways: online, via email, telephone or, finally, in person. The procedure to make the reservation is made up of the following steps:

Stay request: indicating arrival and departure day, according to the availability offered by the hotel; number of nights; type of room and, if they are of interest, the complementary services you wish to reserve.

If the customer has a promotional code they can benefit from special conditions.

The client must provide personal data to execute the reservation.

Reservations are confirmed when the client provides a credit card number and its expiration date (as a guarantee).

If your reservation was made through a travel agency, this card number will be requested at the time of check-in.

Confirmation: once the reservation is confirmed, an email message will be sent, with a description of the reservation made and the personal information that has been provided. Failure to receive this message may be due to a temporary communication problem on the network or a typing error in the email address provided. It is recommended that you contact the establishment again to obtain a copy of the confirmation to review the contracted services. Please keep the reservation confirmation until arrival at the hotel as it can be requested at the reception as proof of the reservation. The same will happen with all agency reservations, which carry a locator that must be provided upon arrival if requested.

All confirmed prices of our reservations include 10% VAT.

4. Children:

All those between 3 and 14 years old are considered children.

They will share a room with their parents, always using one of the existing extra beds.

Children under three years old will be considered babies and can stay without any extra charge.

Minors under 18 years of age must stay accompanied by their mother, father or legal guardians; Otherwise, their authorization will be requested.

Children and babies will have to respect other guests, with parents being responsible for enforcing the conditions indicated by hotel workers.

5. Reservation payment

Prices are only valid in writing and for the period indicated therein. When there are justifiable reasons, Hotel Tàrbena reserves the right to modify rates without prior notice.

The prices relating to the reservation will be indicated to you during the reservation process.

Prices include 10% VAT. Full payment for services must be made at check-in, except for services consumed in other departments that can be charged at check-out. Payments with cards (Visa, Mastercard) are accepted, being mandatory when the amount is greater than €1,000 (following article 18 of Law 11/2021 of July 9). In addition, payments by bank transfer, Paypal and cash are also accepted.

The value of the stay to be paid by the Client constitutes the counterpart for the availability of the use of the hotel room, in the period from arrival to departure.

The total price of the stay will be charged per night, regardless of whether the Client has actually used the room or has spent the night there.

The applicable rates are the agreed prices or the price indicated in the price list of the Hotel Tàrbena in force on the date of conclusion of the contract. Hotel Tàrbena will have the right to increase or decrease the values if a period of more than four months elapses between the date of reservation by the Client and the arrival date or if any tax, visitor contribution or other charges are changed or introduced.

Fees for additional services will be amounts related to complementary services that are not expressly mentioned in the accommodation contract, which are part of the value of the stay.

6. Reservation cancellation and/or modification policy

When the client’s cancellation of their reservation is made 72 hours in advance or more, no cancellation penalty is charged. Cancellation by the client outside this period will result in the charge of the amount of the first night of stay, as well as in case of no-show. In this case, and as long as the client has more than one night contracted, the rest of the nights will be automatically canceled at 12:00 p.m. the day following the expected arrival date.

For any modification or cancellation of the reservation, the client must communicate it in writing.

The Tàrbena Hotel only guarantees the Client the availability of a room of the type of accommodation reserved and not the provision of a specific hotel room if it is not available.

7. Check-in process

The check-in process will be between 1:00 p.m. and 6:00 p.m. on the day of arrival, informing the accommodation in advance of the arrival time. This notice can be given by email, WhatsApp, call or by whatever means the client considers most appropriate.

Identification documents are requested from all room occupants, and registration is mandatory upon arrival at the hotel. The Order of the Ministry of the Interior of the Government of Spain 1922/2003 of July 3 establishes that everyone over 16 years of age must identify themselves with their personal identification number (DNI, passport or residence permit) upon arrival at the hotel. . The registration in books and part of the entry of travelers into Establishments is mandatory by law. Otherwise, the hotel reserves the right of admission.

8. Check-out

8.1 Check out will take place until 11:30 on the day of departure.

8.2 If you wish to extend your stay, let us know immediately, always before your departure time. As long as there is availability, your reservation can be modified.

8.3 If your check-out time is delayed without prior notice, the hotel reserves the right to charge a late check-out fee corresponding to 25% of the active rate at that time. If your departure is delayed until arrivals at 8:00 p.m., you will be charged 100% of the rate applied that night. The above depends on the availability of the room, and it is imperative to leave the room at the request of Hotel Tàrbena.

9. Conditions of use and damage to the accommodation

9.1. Only the people indicated in the accommodation reservation will have the right to use the hotel room.

9.2. When breakages, damages or losses occur, you must inform the accommodation directly.

9.3. Guests should treat the hotel room with care and consideration.

9.4. The Client must treat other guests of the hotel with consideration and respect the hotel rules posted in the hotel and, where applicable, which are also part of the accommodation contract.

9.5. Smoking is prohibited in all rooms, although smoking is allowed outdoors. Animals or pets are not allowed.

9.6. The Tàrbena Hotel does not assume any responsibility in the event of theft, loss or deterioration of valuable objects such as money, jewelry or other objects of considerable value if such events take place in the hotel room or inside the vehicles parked in the parking.

9.7. The Tàrbena Hotel offers its Clients a central hotel safe in which they can store valuable objects, provided that they are duly identified in a document for this purpose.

9.8. If they fail to comply with the regulations, there will be an associated surcharge as a penalty.

10. Gift vouchers

To purchase a gift voucher, you must send an email requesting a quote for the services you wish to include to info@hoteltarbena.com. Subsequently, the quote will be sent to you and as long as there is an agreement on the purchase of the voucher, a card details will be provided by the client to be able to purchase it or a bank transfer will be made for the total value of the voucher. Once paid, this is sent digitally, as well as the purchase invoice in the name of the buyer of the voucher. The vouchers are valid for six months to be consumed, subject to hotel availability and always associated with the desired services, a reference number and a name. In no case is the amount of the purchased voucher returned.

In accordance with the provisions of EU Regulation 2016/679 of April 27, 2016, we inform you that your personal data is processed under the responsibility of Hotel Tàrbena to maintain the commercial relationship, respond to your requests for information and send communications. their interest, so these will be preserved as long as there is a mutual interest for it. The data will not be communicated to third parties, except by legal obligation. You can exercise your rights of access, rectification, portability and deletion of your data by contacting Hotel Tàrbena by email at info@hoteltarbena.com.

11. Claims for defects in the hotel

11.1. In the event of theft or property damage or, in the event of fire, water damage or other damage to the hotel room, the Client must immediately inform the hotel staff and do everything possible to assist in the resolution. of theft or repair of damage.

Hotel Tàrbena and its staff have the right to enter the hotel room, during the Client’s stay, in order to carry out cleaning, repair and similar work.

11.2. In the event that it is verified that there is indeed a defect in the Client’s room, Hotel Tàrbena has the right to choose between repair and relocating the Client in a room that has at least the same category contracted with the Client.

11.3. For the purposes mentioned above, only serious defects capable of jeopardizing the level of service and quality of the Hotel Tàrbena are considered, and the Hotel Tàrbena is not obliged to take action in the case of complaints that are irrelevant, unreasonable or have to do with details that do not conflict with the minimum level of service contracted.

11.4. In the event that the Tàrbena Hotel does not have the necessary means to repair the relevant defect or to replace the Client’s room with another of a similar or higher category, the Client may only terminate the contract and receive the amount paid for the room. not being able to demand anything more from the Tàrbena Hotel for any reason whatsoever.

12. Responsibility on the part of Hotel Tàrbena

12.1. Hotel Tàrbena will only be responsible for damages or losses of the Client when such situations result from the culpable action of Hotel Tàrbena.

12.2. Hotel Tàrbena does not assume any responsibility for loss of data provided by the Client in the case of electronic transmission of payment data, being only responsible if there is culpable action.

12.3. The Hotel Tàrbena does not assume any responsibility for damages or accidents that occur inside the room or any other part of the hotel except if these accidents are caused by the culpable action of the Hotel Tàrbena.

12.4. The Tàrbena Hotel will not be considered responsible to the Client in case of delay in room availability even if there are valid reasons for the timely non-availability of the room.

12.5. For the purposes of the previous number, valid reasons for the impossibility or more difficult availability of the room will be considered, for example, strikes, blockades, natural disasters, accidents in the room or in the hotel.

12.6. In the event of a delay in room availability beyond 4 pm on the day of the reservation, the Client may freely terminate the contract without having the right to demand any compensation from Hotel Tàrbena for any reason whatsoever.

12.7. Hotel Tàrbena does not assume any responsibility for acts carried out by any hotel worker, unless they are during their normal work period.

12.8. The Tàrbena Hotel cannot in any case be considered responsible for the action or omission of any other Client, even if this is likely to cause damage or harm to another Client of the hotel. Any and all damages caused to third parties by hotel Clients will be the exclusive responsibility of these and totally unrelated to Hotel Tàrbena.

13. Termination of the accommodation contract

13.1. Hotel Tàrbena has the right to terminate the accommodation contract in the event that the Client does not pay the price in full and on time when due or does not provide the required guarantee.

13.2. The Client may notify the termination of the accommodation contract during their stay at any time until 7:00 p.m., so that it takes effect from 12:00 p.m. the following day.

13.3. Either contracting party may terminate the accommodation contract summarily for just cause.

13.4. The Tàrbena Hotel will have the right to immediately terminate the accommodation contract for just cause if the Client has any behavior that affects the healthy coexistence, calm or hygiene of the hotel, especially if during his stay at the hotel the Client is under the influence of drugs or alcohol, using the room for prostitution, acting offensively towards hotel staff or other hotel guests, disturbing the peace of other hotel guests or, in the past, has made malicious false reservations and /or damaged or destroyed the hotel or its facilities.

13.5 Hotel Tàrbena reserves the right of admission at any time, paying the proportional part of the reservation that has not been consumed.

14. General provisions

14.1. The terms and conditions fully regulate the Client’s stay at the hotel and their use of the room.

14.2. The invalidity of one or more of the above provisions does not prejudice the validity of the other provisions.
